Suggested clauses for bequest gifts

I. A specific amount or percentage

I give, devise, and bequeath (insert here the sum, percentage, or description of property) to PATH or its successor organization, a nonprofit corporation as described in section 170(b) of the Internal Revenue Code, located at 2201 Westlake Avenue, Ste. 200, Seattle, WA, USA, 98121, to be used for its tax-exempt purposes.

II. The remainder of your estate after you have met family and other goals:

I give, devise, and bequeath all or a portion (e.g., 50 percent) of the rest, residue, and remainder of my estate to PATH or its successor organization, a nonprofit corporation as described in section 170(b) of the Internal Revenue Code, located at 2201 Westlake Avenue, Ste. 200, Seattle, WA, USA, 98121, to be used for its tax-exempt purposes.

III. A gift that occurs only under a specific circumstance.

In the event that (insert name of primary beneficiary) shall not survive me, or shall die 90 days from the date of my death, then I give, devise, and bequeath (insert here the sum or residual portion of the estate that would have been given to the primary beneficiary) to PATH or its successor organization, a nonprofit corporation as described in section 170(b) of the Internal Revenue Code, located at 2201 Westlake Avenue, Ste. 200, Seattle, WA, USA, 98121, to be used for its tax-exempt purposes.

IV. A restricted gift

I give, devise, and bequeath (insert here the sum, percentage, or description of property) to PATH or its successor organization, a nonprofit corporation as described in section 170(b) of the Internal Revenue Code, located at 2201 Westlake Avenue, Ste. 200, Seattle, WA, USA, 98121, (insert here how you would like the gift to be used).

If changed circumstances should, at some future time, make it impractical to use a portion of the funds for the original stated purpose, then such portion of the gift may be used for other related purposes, which the board of directors deems to be in the best interests of PATH, considering the original purposes described above.

Especially in cases where the donor wants to restrict the use of the gift, it is important to meet with PATH staff to ensure that we understand and can comply with your wishes.
